Who qualifies as a first-time homebuyer?

To qualify for the Ontario refund, each buyer claiming it must:

  • be at least 18 years old;
  • be a Canadian citizen or permanent resident, or become one within 18 months after closing;
  • never have owned a home, or an interest in a home, anywhere in the world;
  • not have a spouse who owned a home, or an interest in a home, while they were spouses; and
  • move into the home as their principal residence within nine months after closing.

This is an estimate. Ontario land transfer tax uses the rates the Ministry of Finance has applied since January 1, 2017. Toronto municipal land transfer tax uses the City of Toronto rates in effect since April 1, 2026 (both checked September 2026). The Ontario first-time buyer refund is up to $4,000 and the Toronto rebate is up to $4,475, and both are only available on a home. If only some of the buyers qualify, each refund is reduced in proportion to their share. Buyers who are not Canadian citizens or permanent residents may also owe Ontario's Non-Resident Speculation Tax and, in Toronto, the City's Municipal Non-Resident Speculation Tax.
